Terms of Service
Effective [Effective date]
These terms are an agreement between you (the business signing up, and the people it invites) and [Company legal name] for use of Altriq. By creating an account or using the service, you agree to them.
1. The service
Altriq provides an AI receptionist that answers calls and website chats on your behalf, and business software for leads, scheduling, quotes, invoices, expenses, and timesheets. Features may change as we improve the service.
2. Your account
You must provide accurate information and keep sign-in details secure. You are responsible for activity under your account, including by team members you invite, and for deciding what access each of them has.
3. Plans, billing, and cancellation
Paid plans are billed monthly in advance through Stripe and renew until cancelled. You can cancel anytime; the plan stays active until the end of the period already paid, and fees already paid are not refunded except where required by law. Plans include a monthly call allowance; if you go well past it, we may limit the AI to taking messages until your next billing period, and we'll tell you in advance before charging for extra usage.
4. Call recording, AI disclosure, and your legal responsibilities
Every call answered by Altriq opens with a disclosure that the caller is speaking with an AI assistant and that the call may be recorded, and this disclosure cannot be removed. Laws on recording calls, communicating with consumers, and AI disclosure vary by location. You are responsible for making sure your use of Altriq complies with the laws that apply to your business and your callers, including consent requirements, and for how you use the recordings, transcripts, and information you receive.
You may not use Altriq to place automated or AI-voiced outbound calls or texts to people who have not given the consent the law requires.
5. Payments from your customers
If you accept invoice payments through Altriq, you connect your own Stripe account and payments are made directly to that account. You are the merchant for those payments, and the payment relationship is between you, your customer, and Stripe. Refunds, disputes, chargebacks, and failed bank payments are your responsibility and are handled through your Stripe account, which is also governed by the Stripe Connected Account Agreement. [Company legal name] does not hold your funds and is not a party to your transactions with your customers.
6. AI accuracy
The AI receptionist can misunderstand callers, capture details incorrectly, or miss context. Review leads, bookings, and summaries before relying on them. Altriq does not guarantee any number of leads, bookings, or jobs.
7. Acceptable use
You agree not to use Altriq to:
- break the law or violate anyone's rights, including privacy and consumer-protection laws;
- mislead callers about who they are dealing with, or impersonate another business;
- process information you have no right to use;
- interfere with, probe, or overload the service, or access other customers' data.
8. Your data
You own the business records you put into Altriq. You give us permission to host and process them only to provide and secure the service. Our handling of personal information is described in the Privacy Policy.
9. Availability
We work to keep Altriq running, but the service depends on phone carriers and third-party providers and may occasionally be unavailable. It is not an emergency service — callers with emergencies should contact 911 or the appropriate authorities.
10. Disclaimers and limitation of liability
The service is provided “as is” to the extent the law allows. To the maximum extent permitted by law, [Company legal name] is not liable for indirect, incidental, or consequential damages, or lost profits, and our total liability for any claim is limited to the fees you paid us in the three months before the claim arose.
11. Indemnity
You agree to cover claims brought against [Company legal name] arising from your use of the service in violation of these terms or the law, including claims related to call recording, communications with your customers, or payments between you and your customers.
12. Suspension and termination
You can close your account at any time. We may suspend or end access if these terms are violated, if payment fails, or if needed to protect the service or others.
13. Changes and governing law
We may update these terms; if changes are significant, we'll notify account holders before they take effect. These terms are governed by the laws of [State].
